PRIVACY POLICY OF AKRAPOVIČ d.d.
NOTIFICATION PURSUANT TO ART. 13 OF GDPR

Safeguarding your personal data is very important to us and, accordingly, we strive to ensure the highest level of privacy by providing appropriate technical and organizational measures to ensure a high level of personal data security. All personal data is processed solely on the basis of legal grounds and individual consent declarations in accordance with currently valid standards and legislation applicable to the protection of personal data, in particular as defined in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the "General Data Protection Regulation" or “GDPR”) and Slovenian legislation (the applicable Law on the Protection of Personal Data ("the ZVOP")).

The purpose of this Privacy Policy is to inform all users of our services with all the necessary information related to the processing of your personal data.

PERSONAL DATA CONTROLLER

Personal data controller is the company Akrapovič d.d., Malo Hudo 8A, 1295 Ivančna Gorica, Slovenia (hereinafter: "data controller" or "Akrapovič"). For more information, please refer to “About Us” section of this website.

SCOPE AND PURPOSE OF PERSONAL DATA PROCESSING AND THEIR STORAGE

Your personal data will be carefully protected against any loss, disclosure, alteration or abuse. We will process your personal data solely for the purposes for which you have provided us with them. We will not use your personal data for any other purpose without obtaining your consent or providing your with all the required information in accordance with GDPR in advance.

We collect and process your personal data for the following purposes:

• responding to your questions or requests as submitted through our website and follow-up communication;
• responding to your questions or requests submitted via e-mail and follow-up communication;
• analyses related to the above, including customer history.

For the purpose of responding to your questions or requests related to product information, submitted either via our website or e-mail, and for follow-up communication in relation thereto, we collect and process the following personal data related to you:

• full name;
• country;
• e-mail address;
• segment, brand, model and model year you are interested in.

Your consent for the processing of your personal data is completely free and up to you, and may be revoked at any time by contacting Akrapovič at info@akrapovic.com, without affecting the lawfulness of processing based on consent before its withdrawal. Please note, however, that in case of such revocation, Akrapovič or our partners may be unable to process your question or request.

In case you indicate a country outside of the EU, your personal data may be shared with our partners in the respective country and in such case, your personal data mentioned above will be transferred outside the EU. In such case, you agree that your personal data are transferred to the respective country, i.e. countries outside of EU, that may nor ensure the same level of protection of personal data as is ensured in EU.

For the purpose of responding to your questions or requests related to becoming a supplier, submitted either via our website or e-mail, and for follow-up communication in relation thereto, we collect and process the following personal and other data related to you:

• company name;
• your name as a contact person;
• telephone number;
• e-mail address;
• website address;
• supplier category;
• any additional information you provide in the “Additional Information” box or e-mails.

These personal and other data are processed in order to take steps at your request prior to potentially entering into a contract (item b) of Art. 6/1 of GDPR). Provision of data is necessary to potentially enter into a contract, and unless we are provided with the information listed above, we may be unable to process your request.

For the purpose of responding to your questions or requests related to becoming a distributor, submitted either via our website or e-mail, and for follow-up communication in relation thereto, we collect and process the following personal and other data related to you:

• company name;
• your name as a contact person;
• country;
• telephone number;
• e-mail address;
• website address;
• segment selection;
• any additional information you provide in the “Additional Information” box or e-mails.

These personal and other data are processed in order to take steps at your request prior to potentially entering into a contract (item b) of Art. 6/1 of GDPR). Provision of data is necessary to potentially enter into a contract, and unless we are provided with the information listed above, we may be unable to process your request.

APPLICABILITY OF THIRD-PARTY PRIVACY POLICIES

Akrapovič website uses YouTube API Services related to video content available on the Akrapovič website. By playing videos on the Akrapovič website, you agree to be acquainted with and bound by YouTube Terms of Service (available at: https://www.youtube.com/t/terms) as well as Google Privacy Policy (available at: https://www.google.com/policies/privacy). If you disagree with any provision thereof, you should refrain from accessing video content on Akrapovič website.

No personal data is accessed, collected, stored or otherwise used by Akrapovič related to the use of YouTube API Services.

COMMON PROVISIONS REGARDING THE PROCESSING AND STORAGE OF PERSONAL DATA

All personal data collected on the basis of the abovementioned legal grounds will be used in accordance with the purpose for which they were collected. We will not forward your personal data to third parties without your consent.

Subject to statutory conditions, the data processor may disclose your personal data to the following contractual data processors:

• local partners in the country/ies concerned in order to respond to your request, either within or outside of EU;
• providers of postal, delivery or dispatch services, etc.,
• providers of information technology services in the course of provision and maintenance of software and to application providers.

Personal data may also be used, in a form that does not allow your identification, for the statistical purposes of data controller, such as data on website visits, statistics, etc.

Unless we obtain your specific consent in advance, we undertake not to transfer your personal data to any third country outside of the European Union.

We ensure that your personal data will be stored for such period of time required to complete the purpose for which your personal data were collected and our analysis, namely:

• your personal data collected for the purposes of responding to your question or request related to product information: 3 (three) years from completing the response, which shall be extended for the entire duration of e-mail archiving in accordance with laws, regulations and Akrapovič e-mail retention and archiving policy;
• your personal data collected for the purposes of responding to your request for becoming a supplier or distributor: for the duration of negotiations and the entire term of the agreement, if concluded, and additional five (5) years, which shall be extended for the entire duration of e-mail archiving in accordance with laws, regulations and Akrapovič e-mail retention and archiving policy.

In case statutory obligations for a longer retention of data apply, the latter shall be complied with accordingly.

After the expiration of the above stated retention period, your personal information will be permanently deleted.

Please note that other data related to the product, company or other similar data that does not qualify as personal data, may be stored for a period longer than the periods stated above.

RIGHTS OF DATA SUBJECTS

As data controller, Akrapovič guarantees effective control over your personal data and the enforcement of rights in accordance with the GDPR. You have the right under the GDPR to request access to your personal data, their rectification insofar as the data would not be accurate, erasure or restriction of the processing of personal information related to you, the right to object to such processing and the right to data portability, which should all be addressed to Akrapovič at info@akrapovic.com.

If you believe that the rules of the GDPR or your rights regarding the protection of your personal data were breached, please inform us and we will remedy any possible breach within shortest possible time. You also have the right to lodge a complaint with Information Commissioner at “gp.ip@ip-rs.si” should you consider that the processing of your personal information infringes the GDPR.

Processing of your personal data is not carried out by automated means.

CHANGES OF PRIVACY POLICY

Akrapovič reserves the right to change this Privacy Policy at any time, without prior notification. In particular, this Privacy Policy may be changed when required by law or other applicable regulations.
